List of Practitioners in International Mediation and ADR

VIAC gibt Praktiker:innen im Bereich der internationalen Wirtschaftsmediation die Möglichkeit, sich zu präsentieren. VIAC behält sich vor, zugehende Präsentationen auf die Website zu stellen. Parteien sind bei der Benennung von Mediator:innen und anderen "neutralen Dritten" ebenso frei, wie das Präsidium des VIAC bei der Bestellung von solchen. Ohne eine Empfehlung des VIAC darzustellen, können die Präsentationen Parteien bei der Auswahl von Mediator:innen und anderen "neutralen Dritten", die sich bereit erklärt haben, Verfahren unter den Wiener Mediationsregeln durchzuführen, behilflich sein.

In dieser Liste befinden sich sowohl „eingetragene Mediator:innen“ nach dem österreichischen ZivMediatG, als auch solche, die nicht in der Liste des österreichischen Bundesministeriums für Justiz aufscheinen, weil sie entweder die dafür nötigen Kriterien nicht erfüllen, sich aus anderen Gründen dazu entschlossen haben, von einer Eintragung Abstand zu nehmen oder die österreichischen Bestimmungen des ZivMediatG nicht auf sie anwendbar sind. Bitte beachten Sie, dass in Österreich hinsichtlich Mediationen, die von eingetragenen Mediator:innen durchgeführt werden, aufgrund des ZivMediatG Sonderbestimmungen gelten. So ist während der Mediation durch einen eingetragenen Mediator/eine eingetragene Mediatorin Anfang und Fortlauf der Verjährung sowie sonstiger Fristen zur Geltendmachung der von der Mediation betroffenen Rechte und Ansprüche gesetzlich gehemmt. Weiters ist es eingetragenen Mediator:innen gesetzlich untersagt, über den Inhalt der Mediation vor Gericht auszusagen (Vernehmungsverbot nach § 320 Z 4 ZPO bzw Aussageverweigerungsrecht nach § 157 Abs 1 Z 3 StPO).

Der Umstand, dass Praktiker:innen auf dieser Liste aufscheinen, berechtigen diese nicht, sich als „VIAC-Mediator:innen“ zu bezeichnen.

VIAC offers practitioners in international mediation and ADR the possibility to present themselves on its website. VIAC reserves the right to publish any presentations submitted and to remove them as the case may be. Parties are free to nominate a mediator or a "neutral third person" of their choice and so is the VIAC Board when appointing a mediator. These presentations do not constitute recommendations but may assist the parties in choosing a mediator or a "neutral third person" willing to conduct proceedings according to the Vienna Mediation Rules.

This list contains both, „registered mediators“ in accordance with the Austrian Civil Law-Mediation-Act (ZivMediatG), as well as mediators that do not appear in the list of the Austrian Ministry of Justice because they either do not fulfill the statutory requirements, or have decided for other reasons not to be registered, or the Civil Law-Mediation-Act does not apply to them. Please note that in Austria specific provisions based on the Civil Law-Mediation-Act apply with regard to mediations conducted by registered mediators. In particular, the beginning and duration of a statute of limitations, as well as other deadlines for invoking the rights subject to the mediation are interrupted by law during a mediation by a registered mediator. Moreover, registered mediators may not testify on the content of the mediation at court (interrogation ban in accordance with Sec. 320 no. 4 ZPO and right to refuse to give evidence in accordance with Sec. 157 para. 1 no. 3 Criminal Procedure Code - StPO).

The fact that a practitioner appears on this list, does not authorize this person to use the title “VIAC-mediator”.
