Cost calculator

The cost calculator is only a working tool for parties and interested persons in order to gain an overview of the expected procedural costs for a VIAC arbitration with a particular amount in dispute. It does not replace the determination of the advance on costs by the Secretary General in accordance with Art. 42 Vienna (Investment Arbitration) Rules 2021 or the determination of the procedural costs by the Secretary General in accordance with Art. 44 Vienna (Investment Arbitration) Rules 2021. In particular, no legal claim for a specific arbitrator’s fee will arise herefrom.

Applies to all arbitration proceedings under the Vienna Rules 2021 and under the Vienna Investment Rules 2021 where the claim was filed after 31 December 2024.

*) The Secretary General may increase the arbitrator’s fee by up to 40% (maximum amount) compared to the table of costs (Annex 3, minimum amount) if the case is particularly complex or if the proceedings are conducted particularly efficiently; conversely, the Secretary General may reduce the arbitrator’s fee by up to a maximum of 40% in total, in particular if the proceedings are conducted inefficiently (cf. Art 44 para 7 Vienna Rules).

**) For the calculation of the advance on costs pursuant to Article 42, the Secretariat shall, in addition to the administrative costs and the arbitrators’ fees set out in this Cost Calculator, also take into account any value added tax on arbitrators’ fees, costs for oral hearings and other expenses (cf. Art 44 para 1 subpara 1.1 Vienna Rules), which are estimated and included in the advance on costs.
Therefore, the advance on costs actually prescribed is higher than the amount calculated according to this cost calculator.
