Costs

The cost table for mediation proceedings is an aid for parties and interested parties to get an overview of the expected registration fee and administrative costs for VIAC mediation proceedings. The actual calculation of the advance on costs is carried out by the Secretary General (Art. 8 para. 1 Vienna Mediation Rules 2021) after the proceedings have been initiated. When calculating the advance on costs, the Secretary General also takes into account a deposit on the mediator’s fee, which is calculated according to the actual time spent on the basis of an hourly or daily rate (Art. 8 para. 6 Vienna Mediation Rules 2021). The cost table applies to all mediation proceedings initiated after 31 December 2024.

Registration Fee

  • Pursuant to Art. 4 para. 1 of the Vienna Mediation Rules, the Applicants shall pay a registration fee of EUR 500 (see Annex 3). This is a flat fee.
  • The registration fee will not be refunded.
  • The registration fee shall not be deducted from the paying party’s Advance on Costs.

Administrative Fees

  • For an amount in dispute of up to EUR 500,000 the administrative fees are limited to EUR 2,000. This is a maximum fee.
  • The amounts indicated in the schedule of fees (Annex 3) represent the applicable maximum amounts.
  • The maximum amounts for the administrative fees shall be determined by the Secretary General at the beginning of the proceedings (Art. 8 para. 1 Vienna Mediation Rules 2021).
  • At the end of the proceedings, the administrative fees and the mediator’s fees shall be calculated by the Secretary General and determined together with the expenses (Art. 8 para. 4 Vienna Mediation Rules 2021).
  • The administrative fees are determined at the discretion of the Secretary General, taking into account the particular circumstances of the case, and may not exceed the maximum amount of EUR 2,000.

  • For an amount in dispute from EUR 500,001 to EUR 5,000,000 the administrative fees are limited to EUR 5,000. This is a maximum fee.

  • The maximum amounts for the administrative fees shall be determined by the Secretary General at the beginning of the proceedings (Art. 8 para. 1 Vienna Mediation Rules 2021).

  •  The maximum amounts for the administrative fees shall be determined by the Secretary General at the beginning of the proceedings (Art. 8 para. 1 Vienna Mediation Rules 2021).
  •  At the end of the proceedings, the administrative fees and the mediator’s fees shall be calculated by the Secretary General and determined together with the expenses (Art. 8 para. 4 Vienna Mediation Rules 2021).
