VIAC offers practitioners in international mediation and ADR the possibility to present themselves with their own profile. The arbitrator’s profiles are non-binding and do not constitute the institutions recommendation. The mediators’ profiles are non-binding and do not constitute the institutions’ recommendation. Parties and the VIAC Board are free to nominate and appoint mediators or a “neutral third person” of their own choice.
This list contains both, „registered mediators“ in accordance with the Austrian Civil Law-Mediation-Act (ZivMediatG), as well as mediators that do not appear in the list of the Austrian Ministry of Justice because they either do not fulfill the statutory requirements, or have decided for other reasons not to be registered, or the Civil Law-Mediation-Act does not apply to them. Please note that in Austria specific provisions based on the Civil Law-Mediation-Act apply with regard to mediations conducted by registered mediators. In particular, the beginning and duration of a statute of limitations, as well as other deadlines for invoking the rights subject to the mediation are interrupted by law during a mediation by a registered mediator. Moreover, registered mediators may not testify on the content of the mediation at court (interrogation ban in accordance with Sec. 320 no. 4 ZPO and right to refuse to give evidence in accordance with Sec. 157 para. 1 no. 3 Criminal Procedure Code – StPO).
The fact that a practitioner appears on this list, does not authorise this person to use the title “VIAC-mediator”.
