VIAC Legal Tech Think Tank

The VIAC Legal Tech Think Tank (VIAC LTTT) is an initiative by VIAC to address the growing impact of digital transformation and innovation in the tech sector in ADR.

As the tech industry continues to experience rapid digital transformation and innovation, new product areas such as cryptocurrency, blockchain, and AI are giving rise to new types of commercial disputes. In addition, increased government regulation of big tech companies is expected to lead to a rise in tech-related investor-State disputes. We want to be fit for the future. It is vital for our growth to gather the expertise and knowledge of thought leaders in the sector to steer the institution in the right direction.

VIAC LTTT has three main lines of work:

agsdix-fas fa-search

Identifying specific types of tech disputes that are potentially attractive to VIAC

Contacting tech companies to get an overview of their needs and requirements

agsdix-fa6s fa-book-open

Adapting Vienna Rules to make them meet the needs of the parties in tech disputes

The VIAC LTTT aims to analyse the impact of AI on transparency and disclosure obligations in arbitration proceedings. Both opportunities and risks arising from the use of AI in the collection and evaluation of evidence will be analysed. A particular focus is on the development of a Note on AI to ensure that the use of AI supports the integrity and fairness of arbitration proceedings.

VIAC LTTT brings together experts from the technology sector and alternative dispute resolution to work together on innovative solutions to new challenges. The working group currently consists of 20 members.

“International arbitration and the technology sector – at their very best – they are expeditious and forward thinking. In theory a dream team. However, the reality is different. Why this is and how we as an institution can change it, is what VIAC’s LTTT is all about.”

– Niamh Leinwather, VIAC Secretary General

“One of the main perks of arbitration is having your dispute decided by industry specialists. In no other sector is this consideration more important than in FinTech.”

– Aija Leniece, Independent Arbitrator

“Arbitration offers what tech disputes need: expediency and expertise – if the flexibility arbitration offers is used wisely.”

– David Tebel, Rothorn Legal

“Technology disputes require efficient, confidential and expert decision-making. Arbitration is all that and should, therefore, be explored as a prime avenue for tech dispute resolution.”

– Maud Piers, Independent Arbitrator
